Session Terms and Conditions

By booking a photography session or submitting a deposit, you (“Client”) agree to the following terms and conditions.

1. Photography Services

Photography services are provided by Carol Samuel (“Photographer”) in coordination with The Paw House Inn & Country Cottages.

The package selected at booking determines the session location, approximate session length and number of professionally edited, high-resolution digital images included. Package prices apply to the services specifically described at the time of purchase.

2. Reservations and Payment

A $100 deposit is required to reserve a session. The remaining balance is due at completion of the shoot.

A session is not considered reserved until the deposit has been received and the date and time have been confirmed by the Photographer.

3. Cancellations and Rescheduling

The deposit reserves the Photographer’s time and is nonrefundable except when the Photographer cancels the session and cannot provide a suitable alternative date.

Clients may reschedule once without losing their deposit by providing at least 48 hours notice. Cancellations or rescheduling requests made with less than 48 hours notice may result in forfeiture of the deposit.

If illness, unsafe conditions, severe weather or another circumstance beyond either party’s reasonable control prevents the session from taking place, the Photographer will work with the Client to arrange a new date. Deposits will be transferred to the rescheduled session.

4. Weather and Off-Site Sessions

Outdoor and off-site sessions are subject to weather, lighting, accessibility and safety conditions. The Photographer may change the time or location, pause the session or reschedule when conditions could affect safety or image quality.

Any admission fees, parking charges, permits or unusual travel expenses associated with a Client-requested location will be disclosed in advance and may be charged separately.

5. Dogs, Handling and Safety

The Client is responsible for supervising and controlling their dog throughout the session. Dogs must remain leashed whenever required by law, the property owner or the Photographer.

The Client must tell the Photographer in advance about any history of aggression, biting, reactivity, resource guarding, escape behavior, serious anxiety or other condition that could affect the safety of the session.

The Photographer may stop or modify a session if a dog, person or location presents a safety concern. No particular pose, expression or behavior can be guaranteed. The welfare of the dog will always take priority over obtaining a photograph.

The Client is responsible for any injury or property damage caused by their dog, except to the extent caused by the negligence or intentional misconduct of the Photographer or The Paw House Inn.

6. Cooperation and Session Results

The Photographer will make reasonable efforts to create a relaxed, enjoyable session and capture a variety of images. Results depend on factors including the dog’s temperament, cooperation, health, energy level, weather, lighting and available time.

The Photographer does not guarantee a particular pose, expression, background or number of usable photographs beyond the number of finished images included in the purchased package.

Late arrival may reduce the available photography time. Additional time is not guaranteed and may require an additional charge.

7. Image Selection and Artistic Style

The Photographer retains creative control over posing, composition, lighting, image selection and editing.

The Photographer will select the strongest images from the session for presentation or delivery. Unedited images and RAW files are not included and will not be provided.

The Client acknowledges that the Photographer’s editing and artistic style are part of the service being purchased. Requests for substantial retouching, object removal or editing outside the Photographer’s normal style may incur an additional fee.

8. Delivery of Images

Finished images will ordinarily be delivered electronically within four weeks following the session or the Client’s final image selection, whichever applies.

Delivery times are estimates and may be affected by workload, illness, technical issues or other circumstances outside the Photographer’s reasonable control.

Digital galleries and download links may expire. Clients are responsible for downloading and safely backing up their images promptly after delivery. The Photographer is not required to archive delivered images for more than 6 months.

9. Copyright and Personal-Use License

The Photographer retains the copyright to all photographs created during the session. Purchasing a package does not transfer copyright ownership. Federal copyright law generally gives the photographer ownership of the original photographic work.

The Client receives a nonexclusive license to download, display, print and share the purchased images for personal, noncommercial purposes.

Images may not be sold, submitted for commercial use, used to promote a business, entered into commercial publications or materially altered without the Photographer’s prior written permission. Reasonable cropping for personal printing or social-media sizing is permitted.

When sharing images online, crediting Photography by Carol is appreciated.

10. Printing

The Client may print the delivered images for personal use. The Photographer cannot guarantee the color, cropping, quality or longevity of products ordered from third-party printers.

11. Promotional Use and Privacy

Booking a session does not automatically authorize the Photographer or The Paw House Inn to use identifiable photographs of the Client or their dog for advertising.

Clients may separately authorize promotional use by selecting the optional consent below:

I authorize Photography by Carol and The Paw House Inn & Country Cottages to display selected photographs from my session on their websites, social-media accounts, printed materials, portfolios and other promotional channels without additional compensation.

12. Equipment Failure and Photographer Illness

If the Photographer cannot complete the session because of illness, equipment failure, image loss or another circumstance within the Photographer’s responsibility, the Photographer may offer a replacement session or refund the amount paid.

To the extent permitted by law, the Photographer’s total financial liability relating to the session will not exceed the amount paid by the Client for the photography package.

13. The Paw House Inn’s Role

Unless otherwise stated at booking, The Paw House Inn & Country Cottages provides the session location and assists in making the photography experience available to guests. The Photographer is responsible for providing and delivering the photography services.

14. Governing Law

These terms are governed by the laws of the State of Vermont. The parties agree to make a good-faith effort to resolve any disagreement informally before pursuing other remedies available under applicable law.

15. Agreement

These terms, together with the selected package description and confirmed booking information, constitute the agreement between the Client and the Photographer.

By submitting payment, the Client confirms that they have read, understood and agreed to these terms and conditions.
